SUPREME COURT NOMINEE ELENA KAGAN – CONGRESSIONAL HEARINGS. GENERAL PETRAEUS (Issue 395)

THE CONGRESS, THE COURTS, THE NOMINEE, AND THE FARCE OF THIS WEEK’S HEARINGS

This has been a week of vetting Elena Kagan for Supreme
Court Justice seat and four star General Petraeus to head up American forces in Afganistan. General Petraeus was approved by Senate, 99-0.

Congressional hearings are supposed to be all about selecting a justice to fill a position on the nine-person court, to make decisions on law according to the United States Constitution.

However, because decisions are made by human beings, subject to error, and mis-intrepretation of the essence and over-all meaning of this document of law, it’s of utmost importance for Congressional hearings, to probe and question candidates for the position of Supreme Court Justice.

In this connection, just a note about elementary civics. There are three main branches of government, the Congressional, designed to make the laws, comprised of 535 members. The Executive branch, headed by one person, the president, designed to execute the laws, and the Judicial branch, the Supreme court, comprised of nine members, designed to intrepret the laws. Accordingly, 535 plus one plus nine, is writing the script, pulling the curtain, and ordering the direction. A total of 545 out of 300 million citizens, leading the trek down the road to Socialism.

Despite the fact this is all clear cut, according to The United States Constitution, and so important in all our lives, ask most any child in the tax-supported Socialist school system, to define these 3 branches and they don’t know the difference between the 3 branches and cartoon charactors. They know more about the undersea pineapple house of Sponge-Bob, than the Pennslyvania Avenue house of the U.S. President.

It’s elementary, dear Watson, to have at least a basic knowledge of how it’s all supposed to operate, plus the history of its formation, i.e., The Constitution, to figure out what is happening to the once great Nation. Most of the decisions handed down by the Supreme Court are, 4-5 decisions. Why this consistent split?

Simply because appointees are divided into two opposing views. Some are Liberal, Progressive, Left-wing thinkers, and some are Conservative, Right-wing, Libertarian thinkers. The difference being, a mind-set which thinks political government should be in charge and in control of individuals and personal property, and those who believe in Individual Freedom, and Private Property Ownership. And the nine member court usually makes decisions based upon the difference in these two philosophic difference in thinking.

Usually a candidate selected by the President, is one who leans towards the political philosophy of that President. Currently, the President of the United States, according to his actions and speeches, leans heavily towards the Liberal Left, Progressive mind-set.

In this connection, it is reasonable to assume ANY person he appoints will have a history commensurate with his specific belief system, and manner of Executive governing. Which brings us to the current candidate, Elena Kagan, being questioned in the Congressional hearings.

Elena Kagan comes across as a very likable, charming, well-educated in the law person. One who has spent most of her life in the field of education, political government, politics and law. Never as a judge, but in positions where important judgements were espoused and implemented. In her position at Harvard Law school, as Solicitor-General and advisor to Presidents.

Her answers to questions, manner of expression, intrepretations, and demeanor, comes across quite similiar to the well-spoken, charismatic, charm, and non-specifics of campaign speeches of President Obama. With few exceptions.

In the beginning of questioning by the Judicial Committee members, the general consensus, seemed to be, no one knew much about her background and qualifications to be a Supreme Court judge, because she had never held a position as a Judge. Despite the fact there is plenty in her history and back-ground, to conclude precisely what her political philosophy, thinking, mind-set, and liberal, left-wing, is all about.

I heard no evidence, of any background history, during her fifty years, having any involvement in the free-enterprise, capitalistic system, nor any mention of support from her, relative to individual freedom and private ownership of property. Which, according to anyone who has studied with an open mind, the history of the intent of those who formulated the document of laws, to govern this Nation, meant.

Despite the fact nominee Kagan has been touted as an “intellectual powerhouse” by the media, she came across as one so rehearsed in twiddle-twaddle rhetoric of dodging direct answers to most questions, she in the end came across as one trying to disguise her left-wing, liberal, progressive, dyed in the wool, mind set. Which in my opinion leaves no doubt, as to how she will intrepret the laws of the Constitution of The United States of America.

The consensus of opinion is she will be appointed to the Supreme Court as one of the nine judges. With an undelying notion, if not approved, President Obama would appoint another, with the same value system, relative to intrepretation of the Principles outlined in the U.S. Constitution.

As many of the citizenry here in America struggle with their anger and frustration over the conditions of Socialism already implemented, and the crisis between Freedom and bondage, those elected to represent in Congress, maintain their stance of absence of backbone to stand up for the Principles of the Original Constitution, and go along to get along with the status quo of the current executive edicts and mandates, by rubber-stamping whatever.

No one, other than a handfull of thinkers, have any idea what to do about our current dilemma, aside from electing a new batch of politicians, to follow the same yellow brick road marching down the road of socialism, and destruction of individual Freedom, replaced by a totalitarian central political government.

No doubt, Elena Kagan is an intellectual powerhouse, but it is the intellectualism of the socialist thinkers, which has brought us to this brink. We are past due to return to some down to earth, common-sense morality of just what Freedom means, and how to regain it.

In this connection, I have an upcoming series of articles, relative to an alternate route to reverse our present plight of leaping Socialism.

American author, Kenneth Royce, said: “Liberty is not a cruise ship full of pampered passengers. Liberty is a man-of-war, and we are all its crew.”

If this is true, we are all on a sinking ship, unless steps are taken to reverse the current direction. That is sinking into the bondage of socialism, either brand of Fascism or Communism.
