THIRD IN A SERIES: PROPERTY RIGHTS AND GOVERNMENT INTRUSION

My first article in this series is about my driver’s license cancellation. The second article is about the government confiscation of my vehicle.

This story goes back to the eighties. A time when I stood up and fought back when political government intruded into my life, and infringed upon my personal property Rights.

I was living in an apartment complex in Atlanta, when I injured my back, an injury which took several months of lying around not doing much of anything, to recuperate from the injury.

My apartment was located towards the rear of the complex, a private area, away from the front main buildings. For a period of time I was unable to drive and parked my car near the apartment away from any incoming traffic.

I allowed the insurance to lapse. Since my vehicle was not being driven and parked on private property, I saw no point in paying insurance on it. Then one day I received a notice from Department of Motor Vehicles, that I was in violation of Georgia law requiring insurance, stating I was required by law to surrender my driver’s license and car tag, because it had lapsed.

I called a friend to take me to the post office to mail in my license and tag. Thus began an eight month long battle with the Department of Motor Vehicles over their actions.

I wrote many lengthy letters to the head of DDS, a Mr. Bowman. I took the position that the vehicle was my private property, bought and paid for, parked on private property, and the demand to surrender my license and tag violated my property Rights.

It was my position, inasmuch as the car was not being driven on government tax-paid roads, the requirement for insurance was illegal. And the demand for my license and tag was illegal and violated my Constitutional Right to own property.

I was sent a notice of a fine for not having insurance on the parked car, along with a notice requiring me to reinstate insurance coverage.

I wrote Mr. Bowman and informed him that the state now owned my vehicle and included a statement demanding the state pay me for the car.

I explained in detail to Mr. Bowman that I could not drive the car, I could not allow anyone else to drive the car, nor could I sell it without the tag that the state now had in their possession. Therefore I no longer owned the car, the State of Georgia owned and controlled it. They had usurped all my rights to ownership, and I demanded payment for it. I enclosed a bill for payment.

He wrote back and explained he was not allowed to make payment for the car.

I insisted the state pay me for personal property they had confiscated by taking control of it. Insisted they now owned it, because I no longer had any control of property I had bought and paid for. That the state had arbitrarily confiscated personal property parked on private property without paying me one cent for it, and that was not legal and violated my Rights of Property ownership.

I made no bones about telling him repeatedly, his actions were wrong, by taking my property, demanding my driver’s license, tag and a fine. In essence it was an act of thievery.

After eight months of back and forth letters, I never wavered from my position and just kept writing letters to Mr. Bowman.

Out of the blue after eight months the mailman delivered my license and tag with a notice all fines were cancelled. And that was the end of it, except for one other thing, a couple of weeks later a friend called and read a newspaper article about Mr. Bowman being fired.

Over the years I learned how to fight back with government intrusion and their bullying to control personal property Rights and infringe upon individual Freedom.

However, I reached a place in life where I really did not have the energy to wage the battling required to resist the onslaught of takeover by political government.

Not many would go to the lengths I have, to stand up for Freedom. Because of the apathy of mainstream America, we have reached a point where there is much to do to regain those inalienable Rights we have allowed to slip away from us. Only recently has there been an uprising of protest. I only hope it’s not too late to salvage what little Freedom we have left and regain so much which has already been lost. We are living in a country where most everything is controlled by political policies, rules, regulations and edicts. From the top down, from a centralized power to local bureaucrats.

This series of articles deals with motor vehicles, driver’s licenses and areas related to that. However I could take most any subject in our lives and relate areas of government control.

    The state even demanding you registed your car, and license yourself, is a violation of your self-ownership. It is the camel’s nose under the tent. It’s time that camel got a nose full of buckshot.
